karnak1: Are you absolutely sure about that? Because the games are still advertised in the company's store (even if they're not being sold anymore). Still, GOG or some other company could try to reach Cassandra and reach some agreement.

I can't be absolutely sure even that I live at the current moment. As for the laws I know that there are at least 3 types: franchise ownership rights which should be licensed (Elvira intellectual property), publishing rights (the chosen publisher) and the specific rights related to game developing (the original developer person/team/company which created original lore, characters, stuff, etc.).
So I understand that Horrorsoft/Adventure Soft have the rights for the game but not for the franchise. It's the same as with Baldur's Gate games, no one can sell/publish the game without prior consent from Wizards of the Coast/Hasbro.
